APPLICATION PRIVACY POLICIES

INTRODUCTION

This combined Terms of Use, Privacy Policy, and Content & Usage Policy (collectively referred to as the "Agreement") governs the access, download, installation, registration, use, and continued interaction with the Karban mobile application (hereinafter referred to as the "App"), which is designed, developed, operated, and maintained by Karban Envirotech Private Limited, a private limited company incorporated under the provisions of the Companies Act, 2013 and having its registered office at [Insert Full Address] (hereinafter referred to as the "Company", "Karban", "we", "us", or "our"). This Agreement is binding on all persons, whether natural or juristic, who access or use the App or any of its services, features, interfaces, integrations, or data streams. It comprehensively outlines your legal rights, responsibilities, liabilities, limitations, and duties pertaining to usage of the App and the associated smart appliances offered by Karban.

By using, installing, registering, or otherwise interacting with the App, you hereby affirm that you have read, understood, and explicitly agreed to be bound by the terms set forth in this Agreement. If you do not agree with any clause herein or are not legally eligible to enter into a contract under Indian law, you must not download or use the App.

SECTION 1: TERMS OF USE

1.1 Purpose and Functionality

The App functions as an integrated remote control and monitoring dashboard for Karban's suite of smart home appliances. These appliances may include but are not limited to bladeless fans, multifunctional air purification units, ambient lighting systems, and environmental monitoring devices. The App allows the user to operate, schedule, receive diagnostics from, and monitor the performance of such devices. Further, the App offers real-time environmental data including air quality index (AQI), breathing rate insights, temperature, humidity levels, usage statistics, and energy efficiency metrics derived from connected Karban appliances.

1.2 Eligibility and Restrictions

The App may only be used by individuals who have attained the age of majority as defined under the Indian Majority Act, 1875. Any minors accessing the App must do so under the guidance and consent of a parent or legal guardian. The Company reserves the right to deny, restrict, suspend, or terminate access to the App to any user found violating these eligibility conditions.

1.3 Limited License Grant

Karban hereby grants you a limited, non-exclusive, non-transferable, revocable, and personal license to install and use the App strictly in accordance with this Agreement. This license is granted solely for the purpose of operating compatible Karban devices and may not be sublicensed, redistributed, or used for commercial exploitation.

1.4 User Conduct

You agree not to:

  • Reverse engineer, disassemble, decompile, or create derivative works of the App

  • Exploit, circumvent, tamper with, or disable security mechanisms

  • Use the App for any illegal, harmful, or unauthorized purpose

  • Transmit or upload malware, spyware, spam, or unsolicited communication

  • Harvest data from other users or manipulate AQI readings and environmental data

Violation of these rules shall result in immediate termination of service and potential legal action under the Information Technology Act, 2000 and applicable criminal law.

SECTION 2: PRIVACY POLICY

2.1 Data Collection

To ensure optimal functionality and user experience, the App collects the following categories of data:

  • Personally Identifiable Information (PII): full name, email address, mobile number

  • Phone Number

We are gathering your phone number so that we can securely sign you in by sending an OTP via SMS. This is a very secure way of logging into the app and to access your IOT devices.

  • Technical Data: app logs, Bluetooth and Wi-Fi status, connection diagnostics

  • Geolocation: GPS or IP-based approximate location to enhance region-specific services

We need location permission to scan your WiFi router for:

  1. SSID of your WiFi

  2. To know if your WiFi is using 5G band

If you deny, you can manually enter your WiFi SSID (wifi name). We require this information to help you pair your device with your WiFi router and our servers.

Network Information

We require network information to help you pair your device with your WiFi router and our servers. Pairing the device requires us to know if the app is connected to a specific network e.g. Device’s own wifi.

2.2 Purpose and Use

The collected data is used to:

  • Facilitate device control and synchronization

  • Provide real-time environmental updates and insights

  • Send critical alerts and performance notifications

  • Conduct data analytics and improve product features

  • Fulfill legal and regulatory obligations

2.3 Consent and Control

Your use of the App constitutes explicit consent to collect and process your data. You retain the right to:

  • Access and rectify your data

  • Withdraw consent for certain features (e.g., location tracking)

  • Request deletion of your stored information, subject to applicable laws

2.4 Data Security and Retention

All data is transmitted in encrypted format and stored on secure servers hosted in India or equivalent jurisdictions. Data will be retained only for as long as necessary or as mandated by Indian law.

Security

We value your trust in providing us your Personal Information, thus we are striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security.

Data related to Minors

If you are under 18 years old or you are a minor pursuant to the laws and regulations of the place in which you reside, we recommend you to ask your parents or guardians to read this Policy and use our services or provide your information to us with the prior consent from your parents or guardians. If your guardians do not allow you to use our services or provide your information to us according to this Policy, please stop using our services immediately and give a notice on time so that we can react accordingly. KARBAN do not knowingly collect or store any personal information from anyone under 18 years old. KARBAN will keep personal information of minors confidential and safe in accordance with the relevant laws and regulations.

SECTION 3: CONTENT AND USAGE POLICY

3.1 Permitted Use

You may use the App:

  • For personal control of authorized Karban products

  • To receive Karban-issued content and usage tips

  • To submit lawful, constructive feedback or ratings

3.2 Prohibited Content

You may not:

  • Upload defamatory, obscene, hateful, or unlawful material

  • Disseminate false information about air quality or product performance

  • Manipulate system data or simulate device behavior artificially

  • Post promotional content or ads without written permission

  • Use the App to abuse or harass support personnel or community participants

3.3 Ownership and Intellectual Property

All proprietary content including visual designs, trademarks, illustrations, code, APIs, and documentation belongs solely to Karban Envirotech Private Limited. Unauthorized usage will be treated as a violation of the Indian Copyright Act, 1957.

3.4 Monitoring and Enforcement

We reserve the right to:

  • Audit user activity for compliance

  • Suspend accounts for violating usage guidelines

  • Report serious violations to legal authorities including CERT-In

How can I ask for my data to be deleted?

At any time, you may give, modify or completely withdraw your consent to us for collecting and processing your Personal Information. You may withdraw, modify or limit your consent at any time by going on ‘Settings’ on the Website / App and click on ‘Delete Account’ option or by sending a Request Letter for deletion of account on email: support@karban.in. This will delete all your personal data and anonymize your device-related data.

We may, however, reserve the right to retain and store your Personal Information for our business purposes, whether such Personal Information has been deleted or not, to the extent permitted by law.

Please note that your withdrawal of consent may result in us not being able to provide you with the services or terminate any existing relationship that we may have with you. We will inform you of any such consequences and make reasonable efforts to assist in the transition if applicable.

4.1 Limitation of Liability

Karban shall not be liable for indirect, incidental, or consequential damages arising out of the use or inability to use the App, or inaccuracies in environmental readings or operational diagnostics. The App is provided on an "as-is" and "as-available" basis.

4.2 Governing Law and Jurisdiction

This Agreement shall be governed by and interpreted in accordance with the laws of the Republic of India. All disputes shall be subject to the exclusive jurisdiction of the courts of Jaipur, Rajasthan.
